Softball Strength Foundations – Terms & Conditions

These Terms and Conditions (the “Agreement”) govern your purchase of and access to Softball Strength Foundations, a digital strength and conditioning program delivered through a fitness application (the “Program”), provided by Ellen Kaleikini's Account (“Company,” “we,” “us,” or “our”).

By purchasing, accessing, or using the Program, you agree to be bound by this Agreement.

1. Digital Product & Access

Softball Strength Foundations is a digital training program delivered through a third-party fitness app. Upon purchase, you will receive access to the Program for 10 weeks from your start date.

After the initial 10-week access period, you may choose to continue access for $5 per month, which may be canceled at any time. Continued access is optional and not required to complete the Program.

The Company reserves the right to update, modify, or discontinue the Program or app features at any time.

2. No Refund Policy

Due to the digital nature of this product and immediate access to program materials, all sales are final and non-refundable.
No refunds, credits, or exchanges will be issued once access has been granted.

3. Eligibility & Parental Consent

This Program is intended for youth athletes. By purchasing this Program, you represent and warrant that:

You are at least 18 years of age

You are the parent or legal guardian of the participating athlete

You have the legal authority to consent on the athlete’s behalf

A completed parent/guardian waiver and health questionnaire is required before app access is unlocked.

4. Participant Responsibility

The parent or legal guardian is solely responsible for:

Ensuring the athlete is medically cleared for physical activity

Supervising training as appropriate

Monitoring form, resistance selection, and fatigue

Ensuring exercises are stopped if pain or discomfort occurs

The Program is self-guided and not supervised by the Company.

5. Assumption of Risk

Participation in physical activity carries inherent risks, including but not limited to muscle soreness, strains, or injury.

By participating in the Program, you knowingly and voluntarily assume all risks associated with exercise participation on behalf of yourself and the athlete and release the Company from any and all liability related to such risks.

6. No Medical Advice

The Program is provided for educational and fitness purposes only and does not constitute medical advice.
Always consult a qualified healthcare professional before beginning any exercise program.

7. Proper Use & Modifications

Athletes are expected to:

Follow instructions as demonstrated in the app videos

Use appropriate resistance and equipment

Modify or skip exercises as needed for comfort, fatigue, or scheduling (including practices or tournaments)

The Company is not responsible for injuries resulting from improper use or failure to follow instructions.

8. Account Use & Sharing

Program access is granted to one athlete only.
Sharing login credentials, reproducing program materials, or distributing content without written permission is prohibited.

9. Intellectual Property

All Program materials, videos, text, and content are the exclusive intellectual property of the Company and are protected by U.S. and international copyright laws.

You are granted a limited, non-transferable, non-commercial license to use the Program solely for personal use. Unauthorized reproduction or distribution is prohibited.

10. Results Disclaimer

Results vary based on individual factors including age, effort, consistency, growth, and athletic background.
No specific performance or injury-prevention outcomes are guaranteed.

11. Termination

The Company may suspend or terminate access to the Program at any time for violation of these Terms. Upon termination, access to the Program will cease immediately.

12. No Warranty

The Program is provided “as is” and “as available.”
To the fullest extent permitted by law, the Company disclaims all warranties, express or implied.

13. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, or consequential damages arising out of participation in or use of the Program.

Your sole remedy for dissatisfaction with the Program is to discontinue use.

14. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the Program or breach of this Agreement.

15. Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the State of FL.
Any disputes shall be resolved exclusively in the courts of FL, unless arbitration is required at the Company’s discretion.

You waive the right to participate in class actions or jury trials.

16. Privacy
